Guidelines on the Use of NMP Prehistory Image Data

A. The Guidelines pertain to the use of image and film data of the NMP.

B. Scope of application (referred to as the Applicants):

1. Government organizations, academic institutions, or professionals, scholars whose use is for non-profit purpose such as public services, educational advocacy or academic research.
2. Publishers of books, journals, electronic publications or other products for commercial purpose.
3. Image or film data which copyright belongs to parties other than the museum are not accepted to the Center.
4. Applicants are required to pay the image loyalty fees according to the standard price specified in the guideline (see the attached table), and to cite "Collection of (Provided by) the National Museum of Prehistory" on the image. NMP is entitled to two copies of the sample book after publication.
5. The period for image data loan is 3 months. A fine in the amount of 30% of the rental fee is charged monthly on overdue loans. The overdue period of less than one month is deemed one month. For items that are overdue for 60 days or more, the fine will be accumulated on a daily basis until the return day. The right to loan will be suspended for one year after returning.
6. The number of photo images, films and CD-ROMs loaned should not be over 1/3 of the total collection. In order to avoid redundancies with the museum's research outcome, the use of the same kind of films should not be over half of the NMP's collection.
7. When the number of images loaned for commercial purpose is over 20 or is over half of the total collection, the Applicants are required to pay the standard fees specified in the Guidelines and the loyalty fee, which shall not be less than 8% of the listed price.
8. The authorization to use on the said images is limited to once.
9. If the publication is reedited, or reprinted, the application has to be resubmitted and the fee is entitled to 30% discount.
10. When the content of the publication is in two languages, the fee shall be doubled. When the content is in more than two languages, the fee shall be three times of the standard fee.
11. If the negatives loaned are not usable due to the filing or age, the Applicant has to report to the photographer for a re-shoot, and the fee shall be doubled. However, if the re-shoot were not feasible due to concerns of the safety of the artifact, the application would be denied.
12. If the negatives loaned are of a large volume that needs to be shot separately, the fee is calculated based on the number of films shot.
13. If the negatives are damaged or lost due to the Applicant's negligence, the NMP has the right to charge a fee in double amount and remaking fee.
14. If not requiring the negatives from the NMP, the fee is subject to a 30% discount.
15. The Applicants are required to fill out the application form (download the application form) or explaining the objectives of the use in written forms, and state the names, number of copies, sizes of the images as well as the languages used for publication and the number of prints for submission to the NMP 2 weeks in advance. Once approved, the Applicant can pay the fee and use the images.
16. Individuals with special conditions not stated herein can consult with the museum.
17. Individuals who use NMP's images without prior consent or beyond the authorized extent will be requested for indemnification according to law.
18. The Guidelines is approved by the Director of the NMP and now effective. Same procedure shall apply to future modification.

Notice
A. Correct name and number of copies shall be attached while using the negatives. No exchange on negatives once loaned.
B. Matters concerning the applications, authorized rights, fees, and penalties for overdue and damage of the image data are subject to the Guidelines on the Use of NMP Prehistory Image Data.
C. The fee for negatives of exceptional sizes will be further discussed.
D. Postal costs should be paid by the Applicants.
